The Mexican Social Security Institute [IMSS]- Mandatory use of mailbox
On June 7, 2024, the Official Gazette of the Federation, [in Spanish: DOF], published a decree which amends Articles 286 L, paragraphs one and three; 286 M, first paragraph; Sections XXIII and XXIV are added to Article 5 A, and the second, third, fourth, and fifth are added to Article 286 M. Moreover, the second paragraph of Article 286 L of the Social Security Act, [in Spanish: la Ley del Seguro Social], is repealed.
What are the requirements regarding the use of the Mexican Social Security Institute mailbox?
Article 286 M establishes that the Institute will provide notifications, appointment notices, summons, as well as request or ask for reports, documentation, or issue rulings and report on aspects of interest regarding individuals; through the Mexican Social Security Institute Mailbox.
Individuals must register and keep updated the preferred means of contact with the Institute, in accordance with the guidelines approved by the Technical Council to that end.
When individuals do not provide, submit incorrect data, or do not register or update their preferred means of contact, the Institute will issue notifications pursuant to the provisions of Article 134, Section III of the Code.
Similarly, it is important to remember that the Mexican Social Security Institute, [IMSS], mailbox is an electronic communications system, implemented and managed by the Mexican Social Security Institute, duly established on their website, through which notifications are provided for any procedure, requirement, or administrative decision issued through digital documents, with the added purpose of providing information regarding aspects of interest. Those who may submit to the Institute, petitions or requests related to the exercise of the powers therein, are: beneficiaries, employers, reporting parties, public accountants, certified public accountants, joint and several guarantors, and third-party relationships, whether they are individuals or legal entities or legal representatives who perform procedures for the Institute.
Use of the Mexican Social Security Institute mailbox
Within a 60-day period, the Mexican Social Security Institute will publish in the Official Gazette of the Federation, the requirements and services available in the IMSS Mailbox, as well as the new rules that are of a general nature. The “General Guidelines regarding the Use of the IMSS Mailbox” will remain in force. Once the rules of a general nature are issued, the legal, administrative, and statutory provisions will be repealed that are opposed to the contents in this decree.
