On October 02, 2024, the  Chamber of Deputies approved, by a unanimous vote of 476 in favor to none against,  an initiative that amends the Federal Labor Act, [in Spanish: la Ley Federal del Trabajo], with regard to the right to rest, for those employees who, during an average workday, must stand without the opportunity to sit down, which is known as the “Chair Law”.

The main objectives that this initiative seeks to address are as follows:

• That no employee remain standing during an entire workday, and where appropriate,  be given periodic rest breaks in order to perform his/her duties.

• In this regard, the employer must provide a sufficient number of chairs or chairs with backrests that must be located in specific areas for that purpose, which are designated in the same facilities of the workplace. 

• The same provision will be recognized in industrial establishments, when permitted by the nature of the work performed therein.

Lastly, in provisional articles, the current initiative will come into effect in 180 calendar days from its publication in the Official Gazette of the Federation [in Spanish: el Diario Oficial de la Federación]. It also establishes a period of 30 calendar days from the moment it comes into effect, so that the Department of Labor and Social Services, [in Spanish: la Secretaría del Trabajo y Previsión Social], may publish the corresponding guidelines, and lastly, for employers, who are granted a period of 180 days from the moment the current decree comes into effect; so that they may adapt their internal regulation as needed in order to comply with the said provision.

This initiative passed after a debate in the Senate, and/or with its corresponding approval.
