Following up on the Newsletter issued on November 11, 2021, the Ministry of Economy published in the Federal Official Gazette, on May 9, 2022, the "AGREEMENT by which the Ministry of Economy issues General Rules and Criteria on Foreign Trade." Some of the relevant points are below:

It will no longer be necessary to submit the Certification of Facts for the following procedures:

  • Modification to the registration of a plant, store, or warehouse address.
  • Expansion of the sub-manufacturing companies register.
  • Subsequent expansion of Sensitive Products (Flexibility in authorization per rule 3.3.7.)

Notaries will no longer be able to issue a Certification of Facts. Authorized for its issuance are:

  • Public brokers authorized by the Ministry of Economy on the SNICE portal.
  • DGFCCE: General Directorate of Commerce Facilitation and Foreign Trade.
  • Federal, state, or municipal Public Administration entities or agencies with which Collaboration Agreements are celebrated.

Companies with an IMMEX program may not register legal entities whose IMMEX program has been canceled, in some cases, in the five years before the application filing.

Assumptions are updated for PROSE, IMMEX, ALTEX, and/or ECEX procedures.
