The Ministry of Labor and Social Welfare Launches the New System for Labor Complaints and Workplace Accidents (SIQAL)

The Ministry of Labor and Social Welfare (STPS) has implemented the System for Labor Complaints and Workplace Accidents (SIQAL), a new digital platform that enables workers to communicate directly with the authority to quickly and easily report any violation of their labor rights or accidents occurring in their workplaces.

When can a complaint be filed?

A complaint may be submitted when working conditions are violated, putting at risk the worker’s safety, health, or labor rights. Examples include:

  • Payment below the minimum wage established by the Federal Labor Law.
  • Failure to register with the Mexican Social Security Institute (IMSS).
  • Lack of personal protective equipment.
  • Absence of training required to perform the job.

When to report a workplace accident?

A workplace accident should be reported when the incident has not been notified to the STPS and conditions exist that compromise the physical integrity of workers. 

  • A co-worker suffers a burn injury, and the incident is not reported.
  • A worker sustains a fracture in the workplace and is sent to a private clinic to avoid reporting to the IMSS.

What to do in cases of non-compliance with collective or individual agreements?

If a union did not legitimize the collective bargaining agreement in effect before May 1, 2023, it may have become void. Nevertheless, the employer is still required to respect the previously established rights and benefits.

  • Review general working conditions
    • Verify that all employees are registered with the IMSS.
    • Ensure compliance with minimum wages and statutory benefits.
  • Strengthen safety protocols
    • Document and update accident-prevention procedures.
    • Provide appropriate personal protective equipment according to the position.
  • Continuous training
    • Implement training and technical skills development programs.
    • Formalize the Joint Committees on Training and Safety.
  • Establish internal reporting channels
    • Create internal complaint mechanisms to resolve conflicts before escalation.
    • Promote a culture of respect and labor compliance.
  • Prepare for extraordinary inspections
    • Conduct periodic internal audits.
    • Maintain complete and up-to-date labor records.
