Employer Substitution in IMSS, what happens to disabled workers?

On August 25, 2021, in the H. Technical Council’s ordinary session, it was approved that employers who have notified the Mexican Social Security Institute about the employer substitution may carry out the migration of all their workers, including those temporarily disabled.

Disabled workers must be registered with the substitute company the day after they leave the substituted company, acknowledging the salary with which they were contributing.

This project instructs the heads of the Directorates of Incorporation and Collection, Economic and Social Benefits, Medical Benefits, Innovation and Technological Development, Finance, and Operation and Evaluation, to issue the administrative provisions necessary for the correct application of the agreement.

This was approved for the only time and without setting a precedent, for compliance with the reform to the Social Security Law published on April 23, 2021. This agreement comes into effect on September 9, 2021 (DOF 08/09 / 2021).
