As part of its review of the precautionary measures requested in connection with Decree 1469 of 2025, which set the increase in the minimum wage, the Council of State decided yesterday to provisionally suspend the decree and ordered the agencies involved to issue a new decree specifying the percentage of a transitional increase that will remain in force until final judgment is rendered.

 

Key points of the ruling:

 

  • It has no retroactive effect; therefore, situations already concluded are not affected.
  • The provisional suspension applies as of the issuance of the new decree; in other words, it is not immediately triggered by the Council of State’s pronouncement.
  • The issuance of the new decree is therefore pending; once published, it will take effect from the date of publication, and from that date the new adjustment value must be used for all purposes.
  • The final judgment of the Council of State must be awaited to determine its effects in due course.
